Terms and Conditions
My IP Relay ("Service") and My IP Relay Number are services provided by GoAmerica Relay Services Corp. ("GoAmerica") and are governed by these Terms of Use, the Terms and Conditions of IP Relay service (http://www.ip-relay.com/terms.html), and the About IP Relay and Technical Specifications portions of the website IP-Relay.com (collectively referred to as "Terms of Use"). For purposes of these Terms of Use, "Caller" is a customer who uses the Service and "User" refers to a registered user of My IP Relay Number.
- Agreement: These Terms of use become effective as of Caller/User's first use of the Service and/or My IP Relay Number. Caller/User accepts these Terms of Use as they may be updated from time to time.
- Use of Service. My IP Relay service allows the Caller to place an outgoing IP Relay call by using America Online's Instant Messenger ("AIM") service to contact a relay operator. In order to use the Service, Caller must have access to AIM. To place a call, Caller must send an instant message to the AIM Username "My IP Relay". Caller will be connected to an IP Relay operator, who can facilitate the outgoing call.
- Registration/Use of My IP Relay Number.
- Registration: User must register for MY IP Relay Number at www.IP-RELAY.com. Once User's AIM Username has been registered, User will receive a 10-digit My IP Relay telephone number. User must activate User's My IP Relay Number by sending an Instant Message from User's AIM Username to the AIM Username "My IP Relay" and adding the AIM Username "My IP Relay" to User's Instant Messenger Buddy List. USER MUST ACTIVATE THE 10-DIGIT MY IP RELAY TELEPHONE NUMBER WITHIN 30 DAYS OF ISSUANCE OR THE NUMBER WILL BE REASSIGNED. Telephone numbers that are activate but not used will be reassigned six months after the date of issuance.
- Use of My IP Relay Number: IP Relay operators can use AIM to enable User to receive IP Relay calls through the IP Relay Number designated to User. Users can receive IP Relay calls to User's wireless device or to any computer where User is logged on to the Instant Messenger service. USER MAY NOT USE MY IP RELAY NUMBER TO MAKE OUTGOING CALLS, INCLUDING 911 OR OTHER EMERGENCY SERVICE CALLS. The assigned My IP Relay Number may only be used in conjunction with the AIM service. GoAmerica will assess applicable interLATA, intrastate and state-to-state long distance charges when originating callers dial a My IP Relay telephone number that is outside of the caller's local calling area. GoAmerica also reserves the right to include each User's name and My IP Relay Number in a directory, for the purpose of providing directory assistance service.
- Entire Agreement. These Terms constitute the entire agreement between GoAmerica and User and supersede any and all prior agreements, oral or written, concerning the subject matter. GoAmerica may change the Terms from time to time. Such changes shall satisfy any applicable notice requirements. The Terms are binding upon you and the Company and upon, respectively, you and the Company's agents and heirs.
- Waiver. No waiver of the Terms is valid
- Choice of Law. The Terms are governed by and construed under the laws of the State of New York and applicable federal law, without regard to choice of law principles.
- Severability. If any party of the Terms is finally determined to be invalid or unenforceable under applicable law by a court of competent jurisdiction, than that part or provision will be ineffective only to the extent of such invalidity or unenforceability, without in any way affecting the remain parts or provision of the Terms.
